This book explores the question of how international law is applied by domestic courts. Through case studies and analysis the contributors consider how traditions and diversity affect the interpretation of international law, from a mixture of doctrinal, practical, and theoretical approaches.

The role of subnational regions is ill-conceived in international law scholarship, which has come to slowly accept the important role that cities can play as international actors. Opening up the academic debate for a perspective on regions promises to develop new insights on the divide of governance functions between international organizations and states, regions and cities. At the same time, the regional focus helps to unearth some of the shortcomings of overly enthusiastic approaches to what cities can do as global (...) actors. International law scholarship has found it difficult, however, to engage with the concept of the region. This is owed, as this Article demonstrates, to difficult definitional issues as well as the informalizing bend of a focus on regional governance, which is hard to square with traditions of formalist thinking in international law. Ultimately, the Article argues that regions can function as a useful prism through which to analyze current governance challenges. (shrink)

Even now, however, Wegener's work remains virtually unknown to the English speaking world. Wegener's main work was published in 1885. It has its origin in two lectures given in 1883 and 1884 at school teacher meetings held in the Magdeburg area and it still recalls those (...) original occasions and maintains much of the oral style. Part of the volume treats the subject in a systematic and theoretical manner; other sections contain vivid examples and are characterized by a considerable didactic effort. The book is held together by leitmotif-questions, such as 'How do we understand language?' and 'How does language function as a means of everyday communication?'. We witness the experiences of the talented school teacher and the observations of the innovative dialect researcher combined, condensed, and conceptually ordered.In spite of the relatively unsystematic form of presentation, the book remains thoroughly consistent in thought and argument. In the Untersuchungen we have before us the outline of a communicative and functional view of language structure, of the analysis of speech, and of semantics. (shrink)

In the past decade, research on the dark triad of personality (Machiavellianism, narcissism, and psychopathy) has demonstrated a strong relationship to a number of socially aversive moral judgments such as sacrificial utilitarian decisions in moral dilemmas. This study widens the scope of this research program and investigates the association between dark triad personality traits and anti-natalist views, i.e., views holding that procreation is morally wrong. The results of this study indicate that the dark triad personality traits of Machiavellianism and psychopathy (...) are strongly associated with anti-natalist views. Further, depression is found to be both standing independently in a relationship with anti-natalist views as well as functioning as a mediator in the relationships between Machiavellianism/psychopathy and anti-natalist views. This pattern was replicated in a follow-up study. These findings add to the literature on dark triad personality traits and their relationship to moral judgments, suggesting that personality and mood play a substantive part in variation in anti-natalist views in a lay population. Augustine's treatment of neighbor - love in De doctrina Christiana has been the subject of much criticism in twentieth-century scholarship. Specifically, Augustine is criticized for reducing neighbor - love to an instrumental "use" of the neighbor as a tool in one's personal project of salvation. This paper argues that careful attention to the relationship between Christ and the uti-frui distinction in book 1 of De doctrina reveals a much different conception of "use." Far from advancing an instrumental treatment of the (...) other, Augustine, when he speaks of "using" the neighbor, is developing language to describe acts of charity. (shrink)

The article offers a critical assessment of an article on "Corporate Legitimacy as Deliberation" by Guido Palazzo and Andreas Scherer in this journal. We share the concern about the precarious legitimacy of globally active corporations, infringing on the legitimacy of democracy at large. There is no quarrel with Palazzo/Scherer's diagnosis, which focuses on the consequences of globalization and ensuing challenges for corporate social responsibilities. However, we disagree with the "solutions" offered by them. In a first step we refute the idea (...) of a legitimacy of morals, maintaining that morality is a premodern mode of creating legitimacy. Even worse, moral is becoming a dangerous commodity under conditions of fundamental global disagreements and antagonisms. We secondly refute the concept of the "politicized corporation", maintaining that Palazzo/Scherer disregard the consequences of functional differentiation of modern societies and, in particular, disregard the wisdom of political restraint and constitutional guarantees for the autonomy of different spheres of society. Finally, we refute a seemingly romantic notion of deliberation, maintaining that deliberation and deliberative democracy is a worthy idea, which, however, has no place in the real world of globalized contexts. On the other hand, we also find enough common ground and common concern with Palazzo/Scherer to validate a fruitful discourse. (shrink)

Philological, historical, cultural, cognitive and narratological arguments raise critical objections and question its artificial character. In fact, the incidental episode of the grail functions as a narrative drawer in a plot belonging to the global tale ATU 910B (Good precepts) relating to the part of the work regarding Perceval.

La naissance du CRI à Grenoble doit être replacée dans le contexte intellectuel de la nouvelle critique des années 1960. Les trois courants dominants du matérialisme historique, de la psychanalyse freudienne et du structuralisme ont alors été dépassés par le CRI au profit d’un « nouvel esprit anthropologique » qui privilégiait la réalité sensible des images au détriment des idéologies réductrices. Les intellectuels des villes ont perdu le lien charnel avec une civilisation rurale et un mode de vie ayant façonné (...) notre langue, nos croyances et nos fêtes, ainsi que des artisanats séculaires. Le médiéviste peut encore retrouver le lien avec cette mémoire du temps. Mais s’il n’a pas conservé une âme païenne et un esprit paysan, il est condamné à la posture post-moderne. Penser la culture occidentale en contournant ou ignorant le Moyen Âge n’est qu’une imposture. Un exemple de longue vie des images montre l’importance des relais culturels qui relativise toute théorie préconçue des archétypes. The birth of the CRI in Grenoble is replaced in the intellectual context of new criticism of the 1960s. The three mainstream have been overtaken by the CRI in favour of a “new anthropological spirit” that emphasizes the sensible reality of images at the expense of reducing ideologies. The modern scholars of the cities have lost the carnal connection with a rural civilization and a way of life that have shaped our language, our ancient beliefs and feasts and also centuries-old handicrafts. The medievalist can find the link with this memory of time. But if he has lost a pagan soul and a spirit of peasant, he is sentenced to a post-modern posture. Thinking Western culture in bypassing or ignoring the middle ages appears like a mere sham. An example of long-life images stresses the importance of cultural relays against all preconceived theory of the archetypes. (shrink)

The problem of free will as it is know in Western philosophical traditions is hardly known in China. Considering how central the problem is in the West, this is a remarkable fact. We try to explain this, and we offer insights into discussions within Chinese traditions that we think are related, not historically but regarding the issues discussed. Thus we introduce four central Chinese concepts, namely: (1) xīn 心 (heart, heart-mind), (2) xìng 性 (human nature, characteristic tendencies, inborn capacity), (3) (...) mìng 命 (lifespan, fate, command, allotment, endowment), and (4) zìrán 自然 (self-so, so of itself, nature, spontaneity), and we indicate how these concepts and their discussions can be related to discussions on free will. The white‐rot fungus Phanrochaete chrysosporium has the ability to degrade a wide variety of structurally diverse organic compounds, including a number of environmentally persistent organopollutants. The unique biodegradative abilities of this fungus appears to be dependent upon its lignin‐degrading system. The non‐specific and partially extracellular nature of this system suggests that it may be useful as a supplementary means to treat organochemical wastes.
